MS + 0 years is fine for EB2. I got my PERM approved with MS+ 0 years. No one is trying to bypass the system!. We are trying to figure out the best possible avenue to get our GC.

My suggestion would be to get in touch with your local DMV/auto insurance agent regarding the legal requirements for someone on visitors visa to drive in US.
I am sure he can drive with an Indian international license, but I think "meridiani.planum" is talking more in terms of liability issues. For example, if there is an accident or any other lawsuit (driving or non-driving related), will the sponsored party (the one who sent the letter that got him the visa) be liable?
Does anyone know about this?

Three steps,
1. Your employer or a future employer should file a new Labor for a job that has EB2 requirements and you should be eligible under these requirements.
2. Then apply for an EB-2 140 for this approved Labor by using PD substitution (from your earlier 140). This 140 will be approved under EB-2 and will have your earlier PD.
3. Now you can replace the underlying 140 of your 485 application with the newer one and you will be all set.
Easier said that done though...as PERM in Atlanta is taking a long time and 140 is taking a long time too without Premium processing.

There is no harm in opening a service request (SR) but you have to wait 30 days for the next step after the SR i.e sending followup email directly to the service center if nothing happens to the SR. I opened SR on 9/1 and came to know that SR is still pending and not assigned to any officer. May be they are busy in approving cases so technically I have to wait till Sep 30 to send the followup email. Even if you send the followup email before that 30 days there is no use because you will get an email back to provide the SR number. Hope this helps.

I have a few questions on using AP-
1. I have a valid AP till Jan. 04, 2009. I have applied for a new AP in Sept. last week. Can I travel on my current AP which is valid till Jan. 04, 2009 or will I have any problems with I-485, since I cannot travel on current AP, because I have applied for a new one.
2. Next, suppose I travel on my valid AP (the one till Jan. 04, 2009) in November first week and return on Dec. 10, 2008, what date will I get I-84 till? Will I get it till Dec. 09, 2009 or till Jan. 04, 2008. Ofcourse, the officer will stamp 'Parolee' on I-94, but till what date?
3. Have anyone had any bad experience, when boarding airlines at Indian airports, particularly Mumbai- Do they understand what AP documentation is, in lieu of the normal visa on passport?
Please let me know. Thanks in advance.

#1. A AP does not become invalid, because of overlapping dates or because you applied for new one. You are free to start journey and come back between the validity of an AP (for a reasonable duration for a reasonable reason).
#2. If you are on EB based AOS, stamp "Parolee up to ..." on AP is not significant. It does not affect status, if you stay beyond that stamped date.
#3. Never came across any one having problem in Mumbai. But in some European Countries, issues are there.

Regarding surrendering I-94 upon departure, it has happened that the airline agent forgets to take it out.
On your return it is removed and a fresh one is given at port of entry (no questions asked).

Again if your AP is approved but is in mail or whatever and you leave the country then you are ok (technically) in somebody mailing it out to you otherwise you cannot claim to have satisfied the rule USCIS has put forward and the IO has every right to deny entry at the POE

If one leaves during AP is pending then, at the time of adjudication of the pending AP, the officer can run a query and find that the person has left the U.S. before AP was approved. Then, such AP gets denied because the petition was abandoned . In fact, there was an official memo regarding this some time ago. You can find it under press releases on USCIS website. If, however, the USCIS does not notice that you left and approves AP while you are being outside of the United States, the AP is not valid and upon re-entry CBP may deny entry (if notices). This is why, when applying for AP, one specifies if AP is to be issued to a person who is In US or to a person who is NOT in the U.S. This is needed to satisfy the law. Consequently, it is risky to leave U.S. while AP is pending and not having a visa in a passport.

"To speed up processing" seems like a standard reply for anyone whose case is transferred.
Once it is transferred, you may get the status message that says- "it is following normal processing time"
